Women tolerating violence under the name of ‘personal matter’

“Women in the village M Thumbaraguddi, Sandur taluk face domestic violence. The wives get beaten up by their husbands but they have no complaints against it as it is very normal for them”, said Md Hamsar the village guide and who helped to talk to the victims in the village.

“Every night my husband beats me after returning home but it is very common in our village. Therefore, it’s OK. After this we have a conversation and he understand the matter and the beating comes to a haul for two-three days and then it starts again,” one of thesurvivors of that village, informed.

When asked the victim’s husband regarding the matter, he said, “I work at the mines. I am a lorry driver; I work day and night and drink a lot. After I return home and my wife make any mistake, it bursts my anger and I start beating her and it is our personal matter.”

This village in the Sandur taluk is one of the most back warded villages in terms of infrastructure and literacy rate, there the information was found that the villagers are mostly into drinking and drugs and harassing the women and that is very common in the village, informed Md Hamsar.

Another survivor of that village shares her experience that she had been facing physical harassment since her childhood, and even after her marriage she is facing not only physical harassment but also she has been harassed mentally.“I work in the field and my husband stays at home, if I don’t give him money to drink, he starts beating and abusing me. He becomes normal after he gets what he wants.

The Sub-Inspector of Sandur taluk said that he do not receive many FIRs regarding this matter as the villagers think that this is their personal matter and they do not want to discuss it.

N. Prathap Reddy, Assistant Commissioner of Police of Ashoknagara police station, informed that to dispense justice,it is a Court’s responsibility to solve the matter.Under section 498 of IPC the accused get arrested and the victim gets temporary maintenance. The court takes care of the woman or her family for 20 to 30 days and within that period of time they try to resolve.

Deepthi Ayathan, advocate at Civil Court, informed, “When a victim comes to the judicial procedure to handle such cases, it should be conducted on fast track basis and should be given special importance in hearing the cases as it involves those women’s family.”

Vanitha Sahaya Vani, is an organization for protection of the women. The head counsellor of the organization Manjula Jain said, “Most of the complaints that we get from the women, belong either to educational or economical backward class. The male of the family thinks of their wives as objects. We not only receive cases onphysical harassment, but also mental and sexual harassment. We also get cases that revolve around harassment due to dowry.

We solve cases depending on how that woman wants to solve. We talk it out first and then solve it in office in between the two parties but if the women want her husband to go behind the bar, we work according to the court procedures.”

Law: The Protection of Women from Domestic Violence Act 2005 is an Act of the Parliament of India enacted to protect women from domestic violence. It was brought into force by the Indian government from 26 October 2006. The Act provides for the first time in Indian law a definition of “domestic violence”, with this definition being broad and including not only physical violence, but also other forms of violence such as emotional/verbal, sexual, and economic abuse. It is a civil law meant primarily for protection orders and not for meant to be enforced criminally.

The Protection of Women from Domestic Violence Act 2006 different from the provision of the Penal Code – section 498A of the Indian Penal Code – in that it provides a broader definition of domestic violence.

Domestic violence is defined by Section 3 of the Act as “any act, omission or commission or conduct of the respondent shall constitute domestic violence in case it:

• harms or injures or endangers the health, safety, life, limb or well-being, whether mental or physical, of the aggrieved person or tends to do so and includes causing physical abuse, sexual abuse, verbal and emotional abuse and economic abuse; or

• harasses, harms, injures or endangers the aggrieved person with a view to coerce her or any other person related to her to meet any unlawful demand for any dowry or other property or valuable security; or

• has the effect of threatening the aggrieved person or any person related to her by any conduct mentioned in clause (a) or clause (b); or

• Otherwise injures or causes harm, whether physical or mental, to the aggrieved person.”

Bullets fired and eggs thrown at journalist in Delhi

Journalist, Mitali Chandola, suffered bullet injury after two bike-borne intercepted her car and fired at her in East Delhi’s Ashok Nagar. She was alone and was going home.

“Mitali Chandola was driving alone near Dharamshilla Cancer Hospital when two bike-borne men intercepted her car and opened fire from the front. At least three bullets were fired, two hit and pierced the car’s front windshield. Eggs were also thrown at her car. One bullet hit her right arm. The woman was admitted to a nearby hospital. She will be shifted to AIIMS for surgery,” Joint commissioner of police (eastern range) Alok Kumar.

Chandola works in a television channel in Noida, according to ANI.

Alok Kumar said an attempt to murder case has been registered at the New Ashok Nagar police station. The backstory has not been explored yet and police is considering all the angles. This shows how secure our women and journalists are in the country.

Attack on journalists have become quite frequent. It seems like the Dark Age for the journalists in India has begun. Few days ago, journalists were arrested in Noida for “unacceptable” comments on Yogi Adityanath. Another incident saw the atrocities faced by a reporter, who was investigated a minor train accident. Now, this incident certainly proves the above statement on the Dark Ages for journalists.

Fugitive Nirav Modi arrested in London, denied bail

Finally, the day came when Nirav Modi, our absconded tycoon got arrested. He was arrested because on India’s extradition request in London. He was arrested in central London on Tuesday evening and was produced in the Westminster magistrates court, where the court refused him bail for which he offered 500,000 pounds.

Nirav Modi, 48, is the subject of an extradition request by India, where he is accused of major financial irregularities running into thousands of crores linked to the Punjab National Bank. News agency PTI reported that Nirav Modi contested his extradition to India.

“Nirav Deepak Modi, 48 (Date of Birth 24.02.71), was arrested on behalf of the Indian authorities on Tuesday in Holborn. He will appear in custody at Westminster Magistrates’ Court on Wednesday,” the Metropolitan Police said in a statement.

Produced within hours at the Metropolitan Magistrate’s court, he had offered half-a-million pounds as bail bond, but the court turned it down. He will be in jail till March 29, when the next hearing will take place.

A week ago, the UK issued a warrant against him following India’s request for his extradition. But a decision on the extradition cannot be taken without a long-drawn legal process, as is happening in the case of fugitive liquor baron Vijay Mallya, who fled to the UK in 2017 as banks tried to recover loans to the tune of Rs. 9000 crore from him.

Nirav Modi continues to figure in Interpol’s wanted list on its website. The charges against him, as provided to the international police organization by India includes criminal breach of trust by public servant, or by banker merchant or agent, cheating and dishonestly inducing delivery of property, and money laundering.

His Nirav Modi’s arrest by the Scotland Yard triggered the first stage of the legal process for extradition.

Nirav Modi, whose presence in the UK was confirmed by British authorities in mid-2018, recently figured in a video released by The Daily Telegraph, walking on London streets and responding to queries by its reporters with “No comment.”

He was tracked down to a three-bedroom flat occupying half of a floor in an upscale tower block of luxury apartments, where rent is estimated to be around £17,000 a month, the newspaper reported.

BookMyShow ‘booked’ by Consumer Court for illegal ‘Internet Handling Charges’

An RTI revealed that we were paying extra while booking tickets through BookMyShow. That collection of ‘Internet Handling Charges’ is a violation of RBI’s Merchant Discount Rate (MDR) regulations.

Acting upon the RTI query Vijay Gopal, president of ‘Forum Against Corruption’ a body fighting against corruption has moved consumer court in Hyderabad against BookMyShow, PVR, and the Department of Information Technology. The case is scheduled to be heard on March 23.

If you are one of those who paid the extra ‘internet handling fee’ while booking tickets online, this is for you. The RBI in an RTI query recently stated that online platforms through which movie tickets are booked do not hold the authority to levy handling fees from customers. The reply further explains that this is in violation of the RBI’s Merchant Discount Rate (MDR) regulations.

MDR is basically cost paid by a merchant to a bank for accepting payment from its customers via credit or debit cards every time a card is used in their stores. This essentially means that it is the merchant/trader who has to pay the MDR and not the customer. Therefore levying ‘internet handling fee’ on customers is in violation of the MDR regulations and therefore illegal.

Claiming that this practice is spreading, Gopal alleges, “ Various cab services and food delivery apps like Swiggy are following the footsteps of BookMyShow”. He further said that we as citizens should come together and fight against such malpractices. Gopal also questioned the Ministry of Electronics for failing to keep a track of the violation of RBI’s MDR regulations.

“It seems that Ministry of Electronics is blindfolded by someone on this issue,” he adds.

RTI is a boon for a common man. Though it’s impact has been diluted by the present government but it is still effective. Recent revelation would check the unnecessary ‘snatching’ of money from public’s pocket by such online service providing firms.

Attack on Kejriwal Exposes the Laxity of Security in the Capital

Earlier, females in Delhi were unsafe. Now, even the Chief Minister of Delhi is not safe. After chili powder attack on Kejriwal, Delhi Police arrested a cleric with live bullet when he tried to enter Kejriwal’s house for Janata Darbar. 

“A man was arrested under The Arms Act after a live bullet was seized from him during checking when he went to visit CM Kejriwal yesterday morning. He was among the Muslim clerics who had gone to the CM with a request to increase the salary by Waqf Board,” Delhi Police said.

Delhi police said the cleric told police that he found the bullets in the donation of a mosque, kept it in his wallet and later forgot about it.

This is not the only incident which exposes the security of the Capital. Last week, Kejriwal was attacked by 40-year-old Anil Kumar Sharma with chilli powder when he stepped out of his office after a meeting at the Delhi Secretariat. Sharma was detained by the Delhi Police immediately after the attack.

AAP had claimed that Sharma was a BJP worker and had a history of hurling abuses on Kejriwal through his Facebook posts. Arvind Kejriwal asked Prime Minister Narendra Modi to resign if he cannot ensure the chief minister’s security. 

Unruly Capital

The laid-back nature towards law was proved during Diwali. Supreme Court bestowed sanctions about bursting crackers in NCR. People ridiculed the decision and did what they ‘felt’ was right. In the end, Delhi recorded the worst Air Quality. A mayhem for the residents as smog covered Delhi for days. 

The Delhites’ attitude towards law is visible in the National Crime Records Bureau’s data, which was released in December last year. Criminals in the capital are becoming more and more immune to the police and laws. In that report, Delhi recorded the highest crime against women rate of 160.4, almost treble the national average of 55.2.

A lot of Work is to be Done

Though the traffic rules are still stricter in Delhi than most of the cities in the country. But, still that is not enough. Security of a place is not only decided by the effectiveness of the Police but also by the citizens abiding the law. In Delhi, people escape by saying: jaanta h mera baap kaun h?  (Translation: Do You know who my father is? )

Guide for Criminal Politicians to get rid of their cases

Bypassing judiciary and making fun of the public is a stunt which should be performed by specialists only. Only few specialists are worthy enough to become ‘Sankatmochan’ for their criminal MLAs. This article is a guide, including short notes on two important cases in recent times which taught the politicians how to flush their criminal records. 

Yahweh Yogi

In December 2017, Yogi Adityanath, the Chief Minister of Uttar Pradesh, became immortal in the hearts of his MLAs. He initiated the process to withdraw 20,000 cases against MLAs. He termed them ‘politically motivated’ and tabled the Uttar Pradesh Criminal Law (Composition of Offences and Abatement of Trials) (Amendment) Bill, 2017. 

Maharashtra Government: Knights of the Round Table

Yogi is not the first one but the flamboyant one. Maharashtra Government passed a Government Resolution (GR) in August 2016. Due to GR, 41 cases withdrawn against the MLAs within the span of 15 months. This was the 4th attempt. Government setup a committee which comprised of Cabinet Ministers and Senior Bureaucrats. They cleared the Resolution in no time. Earlier, government attempted the Resolution in 2010, 2015 and in 2016. Senior cops and District Magistrate made up the committee at that time. So, the mission couldn’t be accomplished. 

The most interesting part is that these are the cases which are requested by the government to be dropped as there are meager evidences. Police denies clearly. A senior cop, who was a member of previous committee, has clearly stated that none of the police official gave green signal to the cases. Only MLAs were eager to pass the Resolution. 

Conclusion

Its clear as a crystal. Form the government, first. Divert the mind of the public and then brain-wash them. When the people are busy in fighting for senseless things like castes, religion, etc., pass such Acts in the Assembly. And, your criminal background is as clean as an angel (not Lucifer).
