Set up a trust to build a temple and allot 5 acres of land for the mosque: Supreme Court to Centre

The historical verdict of the 70-years dispute of Babri Masjid and birth-place of Lord Rama is now out. The SC has ordered the Centre to set up a trust to build a temple, as well as allot alternative five acres of land for the construction of a mosque. The decision was taken unanimously by 5-membered bench of judges, headed by CJI Gogoi.

The apex court has ordered the Centre to formulate a scheme in three months to set up a board of trustees for construction of a temple on the 2.77-acres of the disputed land. It has also ordered to allot the 5-acres of land to Sunni Waqf Board for a mosque. The court also said that the destruction of the mosque in 1992 happened in breach of SC orders. The desecration of the mosque by placing idols in 1949 and its demolition was contrary to the law, it added.

The Supreme Court (SC) also appreciated the efforts of the mediators in the Ayodhya mediation panel and said that they came very close to a “settlement”. A panel of mediators led by justice FMI Khalifullah had failed to reach a consensus in the Ram Janmabhoomi-Babri Masjid dispute case. The inability of the panel to reach a consensus was followed by the Supreme Court convening a day-to-day hearing of the case and concluding the hearing procedure in 40 days.

In September 2010, the Allahabad High Court upheld the Hindu claim that the mosque was built on the spot believed to be Rama’s birthplace and awarded the site of the central dome for the construction of a Rama temple. Muslims were also awarded one-third area of the site for the construction of a mosque. The decision was subsequently appealed by all parties to the Supreme Court, wherein a five-judge bench heard a title suite from August to October 2019.

Mumbai, Bengaluru and many other cities levied Section 144 as a precaution when the Supreme Court announced the verdict on the Ram Janmabhoomi-Babri Masjid land title case in Ayodhya. Delhi Police also issued prohibitory orders across the capital. The Himachal Pradesh police have issued a warning against the circulation of fake news in the wake of the Supreme Court’s verdict. Strict penal action will be taken against those who indulge in the circulation of fake news, morphed pictures, doctored videos or any inflammatory material, said Solan Superintendent of Police Madhusudan Sharma in a statement on Saturday morning.

Supreme Court concludes hearing in Ayodhya case

On Wednesday, the Supreme Court concluded hearing on the Ram Janmabhoomi-Babri Masjid land dispute case and reserved the order on the case.

The case was heard by a bench of 5 judges, headed by the Chief Justice of India Ranjan Gogoi. The other members included were Justices S A Bobde, D Y Chandrachur, Ashok Bhushan and S A Zaheer. The bench heard both the Hindu and Muslim sides for 40 days. The court had finished hearing one hour before the deadline.

The hearing for the case has been going on for the past 40 days. The court has asked the parties to give written notes on relief in the next three days, that is, by 19th October.

The day to day proceedings of the case started after August 6 after the two parties could not amicably come on a settlement. After that, the court had revised the deadline for the case. The case had entered an important stage on October 14 when the court resumed the proceedings after Dussehra break.

As the pressure built upon the court to end the proceedings before deadline, the tempers ran high in the court today. Rajeev Dhavan, the senior advocate representing the Muslim council teared up a map that allegedly showed the exact birthplace of Lord Ram. The pictorial map was presented in the court by Senior Advocate Vikas Singh, who was representing the All India Hindu Mahasabha.

Dhavan had objected to Singh’s use of the map in the hearing as it was not registered evidence, and he asked the bench what should he do. The bench sarcastically told him to tear it up, which he took in its literal term and he proceeded to tear the map. Dhavan’s actions caused an uproar in court and he was asked to maintain the decorum of the court or else walk away from the hearing.

Supreme Court condemns Centre on faulty manual scavenging

The supreme court criticized the center heavily for being unable to provide the suitable equipment to manual scavengers, which has led to many lives being lost in recent times. The apex court expressed its concern on the issue, equalling the sewers to тАЬgas chambersтАЭ.

The top SC, in the context of the situation, said тАУтАЬIn no country are people sent to gas chambers to die. But here, 4 to 5 people lose their lives to manual scavenging every month.тАЭ The bench was headed by Justice Arun Mishra and also comprised of Justice M.R. Shah and B.R. Gavai. They termed the situation тАШinhumanтАЩ and questioned the Attorney general K.K. Venugopal, who was representing the state, as to why no protective gears are given to the people involved in the cleaning of manholes and in manual scavenging.

In India, manual scavenging was a role that was traditionally assigned to the members of the Dalit caste. Even after 70 years of independence, people still discriminate on the basis of caste. On this discrimination, the court said-тАЬ70 years have passed since Independence; caste discrimination still persists in the country.тАЭ

It further added-тАЬAll human beings are equal but are not being provided equal facilities by authorities.тАЭ

In 1993, under the Employment of Manual Scavengers and Construction of Dry Latrines (Prohibition) Act the practice of employing people for manual scavenging was banned in India. Moreover in 2012 under the Manual Scavengers and their Rehabilitation Act was passed to reinforce the ban on the practice and included guidelines for rehabilitation of those affected. Still, after the implementation of all these laws, the practice is still prevalent in India mainly in the states of Maharashtra, Gujarat, Madhya Pradesh, Uttar Pradesh, and Rajasthan.

Rebel JDS Lawmakers might approach Supreme Court against Disqualification

Karnataka Government saga doesn’t seem to stop. Rebel Janata Dal Secular lawmaker AH Vishwanath, who was disqualified by the Karnataka Speaker on Sunday, said the decision was “against the law”, adding he and other disqualified legislators would approach the Supreme Court for redressal tomorrow.

Karnataka Assembly Speaker KR Ramesh Kumar on Sunday disqualified 14 more rebel MLAs — 11 from the Congress and three from the JDS — under the anti-defection law till the end of the current term of the House in 2023.

Speaker Ramesh Kumar had disqualified three Congress rebel lawmakers on Thursday.

“The disqualification is against the lawтАж just under a whip served on them, you cannot force the legislators to come to the House,” Mr Vishwanath told news agency Press Trust of India over phone.

“The speaker has disqualified 20 members of the legislature on the grounds that they have not attended the HouseтАж so against this decision pronounced by the Speaker, we are approaching the Supreme Court on Monday,” the MLA said from an undisclosed location.

The disqualifications came a day ahead of Chief Minister BS Yediyurappa seeking the trust vote in the assembly to prove his majority.

Abortion can be decriminalized soon

The Supreme Court on Monday admitted a writ petition seeking decriminalisation of abortion. It also included women to allow the right to exercise their reproductive choice.

тАЬThe right to exercise reproductive choice is the right to choose whether to conceive and carry pregnancy to its full term or to terminate is it at the core of oneтАЩs privacy, dignity, personal autonomy, bodily integrity, self determination and right to health recognised by Article 21 of the Constitution,тАЭ the petition filed by Swati Agarwal, Garima Sekseria and Prachi Vats said.

The response by the Supreme Court was in favor of the petition. A Bench led by Chief Justice of India Ranjan Gogoi issued notice to the Centre on their contention that several provisions of the 48-year-old Medical Termination of Pregnancy Act of 1971 imposes severe restrictions on the reproductive choice of a woman, her personal liberty and bodily autonomy. The court asked the government to respond to the petition.

The law largely allows a woman to abort only if continuance of the pregnancy, according to a medical practitioner, involves a risk to her life; grave physical or mental injury; or risk of serious foetal abnormalities. This is the case even in case the pregnancy is less than 12 weeks old. It is also observed that the first trimester of pregnancy entails lesser risk for abortion. Besides, the State has no legitimate interest for interfering in the right of reproductive choice of a woman, curtailing her right to terminate her pregnancy.

тАЬThe restriction puts an undue burden on the exercise of free reproductive choice and renders it meaningless. This provision in substance makes right to terminate pregnancy an exception, which is otherwise recognised as an important facet of right to life, human dignity and self determination,тАЭ the petition said.

The petition said abortion, as per the 1971 Act, is not permissible after 20 weeks of pregnancy. This is excessive and harsh. The Medical Termination of Pregnancy (Amendment) Bill 2014 and Medical Termination of Pregnancy (Amendment) Bill 2017 have proposed to enhance the cap for termination of pregnancy to 24 weeks.

Several genuine cases had come up where foetuses with serious risk of abnormalities causing grave risk to the physical and mental health of the mother were noticed after the 20-week period. тАЬAs a result, many women were forced to move the Supreme Court for permission to end their pregnancy. This had led to a lot of mental and financial hardship to pregnant women,тАЭ the petition recounted.

The petition might seem a progressive step to honor the women residing in the country. It demands more freedom for the women in terms of contraception choice and whether to conceive or not. This automatically reduces burden on women. On the other hand, Supreme Court should also make sure that this law, if enforced, should not be misused in order to kill the female foetuses.

Supreme Court rejects тАШdosa kingтАЩ RajagopalтАЩs plea for relief

Obsession can be self-destructive. The Saravana Bhavan founder, P Rajagopal, was accused of the abduction and murder of Shantakumar, husband of Jeevajyothi, whom he wanted to marry in 2001. The Supreme Court has now rejected his plea for relief on medical grounds.

Justice NV Ramana on Tuesday rejected the extension of deadline and said he must surrender immediately. Rajagopal was out on bail granted to him in 2009 on health grounds and was directed by the court to surrender by July 7.

The top court had in March confirmed the punishment of life sentence on P Rajagopal for the murder of Santhakumar. Delivering its verdict, a three judge bench of justices N.V. Ramana, Mohan M. Shantanagoudar and Indira Banerjee had held that, тАЭHaving regard to the entire material on record and the totality of the facts and circumstances, we find that the evidence on record fully proves the case of the prosecution.тАЭ

In 2001, P Rajagopala was accused of the abduction and murder of Shantakumar, husband of Jeevajyothi, whom he wanted to marry. The woman was already married and rejected his advances, but Rajagopal did not stop. He started giving threats, beatings, and exorcism directed towards the woman, her husband and her family. In 2001, after one failed attempt, the husband was murdered on RajagopalтАЩs orders.
